We've filed appeal against reinstatement of Etsako East council chairman - Edo government

The  Edo state government has filed  an appeal and stay of execution against an Edo high court judgement which ordered reinstatement  of Alhaji Aremiyau  Momoh  aka Mbakwe as   chairman  of  Etsako East local government area of Edo state.

Justice Daniel okungbowa of Edo high court had in a recent judgement declared as illegal, null and void the suspension of the Etsako East council chairman by the state governor, Mr Godwin Obaseki.

The  Edo state government position was  disclosed by  the Edo state publicity secretary of the People's  Democratic Party, the rulling party in the  state,
Chris Osa Nehikhare through a press statement.
 
The decision of the state government to file an appeal against the judgement  will probably  dashed  the hope of Hon  Momoh reclaiming his seat before the expiration of his tenure in  office which will be by March 2020 considering the slow pace of litigation   in Nigeria.
 
Prince Nehikhare statement came as a reaction to a statement credited to the APC caretaker chairman, col. David Imuse which accused  Governor Godwin obaseki administration of disobedience to court order.

In the words of Col. Imuse "Edo state has a governor who does not have one iota of respect for the judicial and legislative arms of government or the rule of law although he regularly runs to the courts on the most frivolous of excuses".

According to Imuse: "A court recently ruled that the duly elected chairman of Etsako East Local Government Council who was illegally removed from office should go back to his seat. But the Governor, in disobedience of the Court, mobilised thugs to seal up the entrance of the Council Secretariat at Agenebode, denying the Chairman access".

The Edo state PDP  publicity Secretary in a reaction said:
"As for the complaint about the situation in Etsako East Local Government Area, the state government is exercising its constitutional right for an appeal and has, along that line, filed for an appeal. It has also filed for a Stay of Execution on that judgement. Therefore, status quo remains and only the court can make a pronouncement on the matter and not the APC.”
